Terms of Service

By accessing the Fouz Digital website, subscribing to our services, or signing a digital service proposal, you agree to be bound by these Terms of Service, all applicable laws, and regulations. If you do not accept these terms, you are prohibited from utilizing our platforms, products, or service networks.

These terms constitute a legally binding agreement between you (the client) and Fouz Digital. They govern all projects, ongoing support, and general agency transactions.

Fouz Digital is a professional premium digital agency specializing in custom-engineered digital solutions. Our core service portfolio includes:

• Web Development: Custom web platforms, SaaS product architectures, and enterprise system designs.
• Digital Marketing: Search Engine Optimization (SEO), performance marketing campaigns, and social media brand development.
• Creative Solutions: Custom graphic design, branding kits, corporate copywriting, and high-end video production.
• Server Management: Linux server configurations, performance tuning, and 24/7 server monitoring audits.

Each service is subject to its respective statement of work (SOW) outlined in client proposals and contracts.

To ensure successful project outcomes, clients agree to cooperate proactively with Fouz Digital's development and marketing teams. Your obligations include:

• Providing all brand guidelines, website copy, imagery, and credentials (hosting logins, DNS access) in a timely manner.
• Reviewing progress updates, UI mockups, and alpha builds within the agreed timeline (usually 3–5 working days).
• Ensuring all provided assets do not infringe upon any third-party intellectual property or copyright laws.

Delays in asset provision or milestone feedback will extend project timelines accordingly.

Payments for our digital solutions are processed based on the terms established in individual client agreements:

• Milestone Invoices: Custom web projects require an upfront deposit (e.g., 50%) prior to design and development. The balance is invoiced at predetermined development milestones.
• Marketing Retainers: Monthly digital marketing, SEO, and server management retainers are billed in advance at the start of each service cycle.
• Late Fees: Overdue invoices are subject to a late fee of 1.5% per month on outstanding balances.
• Refund Policy: Due to the custom nature of our engineering, design, and marketing services, all payments are non-refundable once work has commenced.

Ownership of intellectual property (IP) is transferred as follows:

Upon receipt of full and final payment, Fouz Digital transfers all intellectual property rights for the finalized website design, frontend code, and custom graphics to the client. The client receives full ownership of their custom website and properties.

Fouz Digital retains the rights to any pre-existing code libraries, framework components, server script structures, and generic logic developed prior to or during the project. We also reserve the right to showcase the completed project in our agency portfolio and marketing case studies unless a non-disclosure agreement (NDA) is active.

To the maximum extent permitted by law, Fouz Digital, its directors, developers, and marketers will not be liable for any indirect, incidental, special, or consequential damages resulting from your use of our services.

This includes, but is not limited to, loss of business revenue, server downtime, database corruption, search engine ranking changes, or advertising expenditure losses due to algorithm changes or server provider outages. Fouz Digital's total liability will never exceed the amount paid by the client for the specific project or service cycle that caused the claim.

Fouz Digital aims to deliver all custom websites, brand assets, and marketing campaigns in accordance with the schedules proposed in our scope documents.

All timelines are estimates. We are not responsible for delays caused by client revisions, late feedback, third-party API issues, hosting provider setup delays, or force majeure events. Projects will be marked complete and delivered upon client sign-off or the deployment of files to the production environment.

Following website launch, Fouz Digital provides a complimentary 30-day bug-support window. During this phase, we resolve code bugs or functionality issues that do not comply with the initial project specifications.

Any additional updates, content edits, server setups, or feature enhancements requested after this window are billed at our standard hourly rate or covered under an active monthly Server Maintenance and Support Retainer contract.

Either party may terminate an active service agreement under the following conditions:

• Marketing Retainers: May be cancelled by either party with a written 30-day notice prior to the start of the next billing cycle.
• Project Termination: If a client halts an active custom project, Fouz Digital retains the initial deposit to cover expenses and hours already logged.
• Breach of Terms: Fouz Digital reserves the right to suspend services or website hosting immediately if the client breaches any payment term, code license, or legal regulation.

Fouz Digital reserves the right to review and update these Terms of Service at any time without prior individual notice. All updates will be published directly on this webpage. Your continued use of our platforms or engagement of our services after updates are posted indicates your acceptance of the revised Terms of Service.
